How to get through the divorce process

There are a few basic steps in the divorce process, which you must follow.

The first step is getting separated. One of you must move out of the home in which you both live. This is because of the requirements the court has to accept your file for divorce. There is a period of time you have to spend apart of your husband or wife so you can move on to the other steps of the divorce process.

The second step of the divorce process is filling a petition. After you cover the requirements for the period of separation you have to prepare the petition. It's also known as form D8. You may use an attorney to help you or an online divorce service. In the petition you must mention the grounds for divorce. There may be different reasons for having the decision of getting divorce and you must state them in the petition. You must also mention the controversial financial and material issues you have with your husband or wife. The petition must be in three copies - one for your spouse, one for you and one for the court.

The third step is serving your spouse with the petition. If he or she does not agree with some of the details in the petition a respond should be made in a specific period of time, according to the divorce process requirements.

The forth step is trying to reach an agreement. This allows you and your spouse to save some money and miss the trial in the divorce process. This can be achieved through mediation. If you are capable of reaching and agreement on the child custody and support, alimony, property and other related issues then you get all your documents settled and your divorce process finalized.

The fifth step of the divorce process is a temporary hearing. You can ask the court to give you a temporary order on the controversial issues which must be clarified during the divorce process. The order may determine who will have the temporary custody over the children, who will receive the alimony and child support, who will live in the shared before home and so on during the divorce process. The court may even give a restraining order to either of the spouses.

The sixth step of the divorce process is the trial. Sometimes it may be long and hard; mostly it costs a lot of money and time, so this is why you should try to reach an agreement before that. During the trial the judge decides how the controversial issues should be settled (child custody, child support, alimony, division of property and etc.).
